Rapper Lil Durk asks for two scholars to explain drill to jurors

Lil Durk's lawyers are fighting to keep two expert witnesses, Dr. Erik Nielson and Dr. Lance Williams, in front of jurors at his murder-for-hire trial, arguing jurors need scholars to separate drill rap performance, Chicago gang culture and claims about real events. Prosecutors call the testimony repetitive and question Nielson's fit with drill specifically.

Nielson, who chairs the liberal arts program at the University of Richmond and co-wrote Rap on Trial: Race, Lyrics, and Guilt in America, has testified in cases nationwide including Young Thug's Georgia RICO prosecution, and argues Durk's lyrics are "hyperbole and creative expression" rather than biography. Williams, who teaches at Northeastern Illinois University and has 25 years of Chicago gang-intervention experience, would speak to gang structure and rebut the prosecution's own gang expert.

A judge has already ruled that prosecutors may use Durk's 2021 song "Pissed Me Off" and its music video as trial evidence, over defense objections that the material could unfairly color jurors. Prosecutors argue lyrics about putting up money for a gun and a car support their theory that Durk was willing to pay for retaliation over the death of his friend and fellow OTF artist King Von; the defense says the song is actually a tribute to Durk's slain brother, Dontay "DThang" Banks Jr.

Prosecutors allege Durk paid five men to kill Quando Rondo in 2022 in retaliation for Von's 2020 killing by Rondo associate Timothy Leeks, and that the resulting Los Angeles attack instead killed Rondo's cousin, Saviay'a "Lul Pab" Robinson. Durk, legally named Durk Banks, has pleaded not guilty and now faces a fourth superseding indictment splitting the stalking charges into two counts, bringing his total to seven; he has also fought a proposed gag order, arguing prosecutors already shaped public opinion through indictments and press releases.

Federal prosecutors have separately asked a judge to seal their witness list, with reports putting the number of prepared witnesses at 35. Jury selection was scheduled to begin August 20, with opening arguments as early as August 21. The dispute over drill's use as evidence has become a closely watched test case for hip-hop more broadly.
